Video Greeting Card Terms & Conditions

About the Service

Daily Blooms' Video Greeting Card service allows customers to record and upload a personalised video message to accompany an eligible order. The video is accessed by the recipient via a QR code included with their gift.

Use of the Video Greeting Card service is subject to these Terms & Conditions, together with our Privacy Policy and Website Terms of Use.

Your Responsibility

By recording and uploading a Video Greeting Card, you confirm that:

  • you are at least 18 years of age, or have the permission of a parent or guardian;

  • you have the right to upload the content;

  • any people appearing in the video have consented to being recorded where required;

  • the content does not infringe any copyright, trademark, privacy or other rights of any person; and

  • the content complies with these Terms & Conditions and all applicable laws.

You are solely responsible for the content of your Video Greeting Card.

Prohibited Content

Video Greeting Cards must not contain content that:

  • is unlawful, defamatory, abusive, threatening or harassing;

  • contains hate speech or discriminatory content;

  • is sexually explicit or obscene;

  • promotes violence, illegal activity or self-harm;

  • infringes another person's intellectual property rights;

  • contains viruses or malicious code; or

  • is otherwise inappropriate, offensive or likely to cause harm.

Daily Blooms reserves the right to refuse, suspend or remove any Video Greeting Card that breaches these Terms or that we reasonably believe may expose Daily Blooms or others to legal or reputational risk.

Availability

While we aim to ensure Video Greeting Cards are available and accessible, we do not guarantee uninterrupted access.

Availability may be affected by technical issues, maintenance, internet connectivity or third-party service providers.

Video Storage

Video Greeting Cards are stored for a limited 30 day period to enable recipients to access their message.

After this period, the video may be permanently deleted without notice. The applicable retention period is outlined in our Privacy Policy.

Customers should keep their own copy of any video they wish to retain.

QR Code Access

The Video Greeting Card can be viewed by anyone who scans the QR code accompanying the gift.

Daily Blooms is not responsible for unauthorised access where the QR code has been shared, copied, photographed or otherwise made available to others.

Customers should avoid including confidential, sensitive or highly personal information in their recordings.

Daily Blooms staff will not access your video except in the event that it is reported.

Intellectual Property

You retain ownership of the content you create.

By uploading a Video Greeting Card, you grant Daily Blooms and our service providers a non-exclusive, worldwide, royalty-free licence to host, store, process and transmit the video solely for the purpose of providing the Video Greeting Card service and complying with our legal obligations.

We do not use your Video Greeting Card for advertising or promotional purposes without your separate consent.

Third-Party Providers

Daily Blooms may use trusted third-party technology providers to host, process or deliver Video Greeting Cards.

By using the service, you acknowledge that your video may be processed by these providers in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Daily Blooms is not liable for:

  • loss or corruption of uploaded videos;

  • delays in video processing or delivery;

  • inability of a recipient to access a Video Greeting Card due to device compatibility, internet connectivity or technical issues outside our reasonable control; or

  • unauthorised viewing arising from the sharing or misuse of a QR code.

Nothing in these Terms excludes rights or guarantees that cannot be excluded under the Australian Consumer Law.

Changes to the Service

Daily Blooms may modify, suspend or discontinue the Video Greeting Card service at any time.

Where reasonably practicable, any material changes will be reflected in these Terms & Conditions.
